The Convenor welcomed all present and introduced Bill Stewart, to members of the Board who were not at the previous planning meeting. 2. Apologies were received from the above Members. AGENDA ITEM 3: MINUTES & MATTERS ARISING FROM THE PREVIOUS MEETING 3. The minutes of the previous meeting, 24th July 2009, held at The Community Hall, Boat of Garten, were approved subject to amending Item 49e to include a clarification response on the use of a condition as opposed to a Section 75 Legal Agreement, delete repeated item 51 and delete Fiona Murdoch and Andrew Rafferty from Item 76 voting sheet. 4. As such the proposal represents a significant addition to the recreational network that passes through an area that is subject to a wide number of nature conservation designations. The proposal is therefore of general significance to the collective aims of the Cairngorms National Park. 20. 09/246/CP - No Call-in 21. 09/247/CP - No Call-in Lucy Grant declared and interest and left the room 22. 09/248/CP - The decision was to call-in the application for the following reason : • The proposed development is on land which is identified as an area of forestry / restraint in the existing Badenoch and Strathspey Local Plan, with the land being partially wooded. The proposal is of general significance to the aims of the Cairngorms National Park, in terms of conserving and enhancing the natural heritage of the area, and also the social and economic development of the area. Lucy Grant returned 23. 09/249/CP - No Call-in 24. 09/250/CP - The decision was to call-in the application for the following reason : • The area of land which is proposed to be enclosed by a new boundary fence includes the curtilage of an existing residential property and also an adjacent area of woodland which is allocated in the Badenoch and Strathspey Plan (1997) as amenity woodland. PAGE 3 A candidate core path also runs through the identified site boundaries. The proposed development is of general significance to the aims of the Cairngorms National Park as it has the potential to impact on the natural heritage of the area, and also has implications for the enjoyment of the special qualities of the area by the public. 25. 09/251/CP -No Call-in 26. 09/252/CP -The decision was to call-in the application for the following reason : • The proposal involves the erection of a bottling plant and storage building at the Cairngorm Brewery. The proposal represents the first phase of the replacement of the entire brewing facility. Consistent with a previous application of this nature on the site, the proposal is considered to raise issues with regard to economic and social development of the business and natural heritage issues with regard to the adjacent landscaping belt. The proposal also raises issues with regard to sustainability including the reduction of transport movements from the site and in relation to re-use of energy within the facility. Consequently, the proposal is considered to raise issues of general significance for the collective aims of the Cairngorms National Park. COMMENTING ON APPLICATIONS NOT CALLED-IN BY THE COMMITTEE 27. The Members wished to make comments to the Local Authorities on the following Planning Application No’s 09/233/CP, 09/236/CP, 09/237/CP, 09/244/CP, 09/247/CP & 09/249/CP. The planning officers noted these comments and were delegated with the responsibility of whether or not to submit the comments to the Local Authorities. AGENDA ITEM 6: ANY OTHER BUSINESS 28. The Convenor updated the committee on the issue of the high level of camping overspill in Glenmore. Murray Ferguson is leading a Working Party which has made progress, speaking to various parties to deal with this significant issue and Planners are being kept informed. AGENDA ITEM 7: DATE OF NEXT MEETING 29. Friday, 21st August 2009, 10.30 a.m. at Albert Memorial Hall, Ballater. 30. Committee Members are requested to ensure that any Apologies for this meeting are submitted to the Planning Office in Ballater. 31. The meeting concluded at 11:15hrs.
